Application Terms
1. These terms
These terms govern your use of the Inerture applications (the Apps) — the modelling, analysis, and reporting tools at inerture.app — provided by Inerture (ABN 35 110 646 360) (“we”, “us”). They are the separate terms referred to in our Terms of Use, which continue to govern the website. By using the Apps you agree to these terms. If you do not agree, please do not use the Apps.
2. Your licence
While your access is current, we grant you a revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Apps for your own engineering work or your employer’s. That is the whole of what is granted; everything not granted here is reserved.
3. Access and accounts
Access is invite-only. Your account is yours alone: keep your sign-in details secure, do not share them or let anyone else use your account, and tell us promptly if you believe someone has.
4. What you must not do
You agree not to:
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, or underlying ideas of the Apps, except where that restriction cannot lawfully be excluded;
- circumvent or interfere with any measure that meters, limits, or protects access to the Apps;
- access the Apps or the interfaces behind them by automated means, other than through the Apps themselves;
- resell, rent, sublicense, or otherwise make the Apps available to anyone outside your organisation, or provide them to a third party as a service;
- use the Apps, or anything learned from them, to build or improve a competing product; or
- interfere with the Apps or the servers they rely on, scrape or harvest content from them, or impersonate any person or misrepresent your affiliation.
5. Your work
You own the models, drawings, calculations, and reports you create with the Apps (your Work). We claim no ownership of it. You grant us only the limited permission we need to store, process, back up, and display your Work in order to run the Apps for you.
6. Our software
The Apps — including their code, interfaces, content, and the way they implement the calculations they perform — are owned by us or our licensors and protected by intellectual-property laws. Section 2 grants a licence to use them; it transfers nothing else.
7. Alpha release
The Apps are in closed alpha. They may change, break, or be withdrawn without notice, and your work may be reset between releases. We make no commitment as to availability, and you should not treat the Apps as the only copy of anything that matters to you.
8. Professional judgement
The Apps assist a qualified engineer; they do not replace one. Results are not engineering advice and must be checked by a competent person before they are relied on, issued, or used for construction. The engineering decisions remain yours.
9. Suspension
We may suspend or withdraw your access if you breach these terms, or if we reasonably believe your use puts the Apps, other users, or their work at risk. Where it is practical to do so, we will tell you first.
10. Liability
The Apps are provided on an “as is” and “as available” basis. To the extent permitted by law, we exclude all warranties, express or implied, and our liability arising from your use of the Apps is limited, to the extent permitted by law, to re-supplying the relevant service.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded.
11. Changes
We may change these terms at any time. The current version will always be at this URL, and changes take effect when posted. Where a change is material we will ask you to accept it the next time you sign in.
12. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
